Terms and Conditions
Scope of application
Only the Terms and Conditions below in the version applicable at the point at which an order is placed in our online shop, by telephone, fax or email apply to business relations. Should individual terms and conditions be or become invalid, this does not affect the validity of the other terms and conditions. Austrian law applies to the exclusion of the United Nations Sales Convention. All spelling, printing and calculation errors and extraordinary price changes are reserved.
These Terms and Conditions also apply to future orders placed by customers, even if they are not explicitly agreed once more.
Conclusion of contract
When you place an order with us, this constitutes your offer to us to conclude a purchase contract. The purchase contract is concluded by means of our written confirmation and delivery of the ordered goods by us.
Images only represent approximations, unless it is indicated, in relation to a specific product, that a specific image is binding. Minor and objective changes to the product are possible and are explicitly accepted upon placing an order.
We are entitled to refuse or to accept orders placed by resellers within an appropriate period of up to three working days, for example after conducting a creditworthiness check or checking whether the goods are available (in sufficient quantities).
Terms of delivery
Unless otherwise agreed, deliveries are made from our warehouse to the delivery address indicated by you, and on your account and at your risk. All details regarding the availability, shipment or delivery of a product are merely indicative and represent approximate reference values. They do not constitute binding or guaranteed shipping or delivery dates. Should we be responsible for your delivery being delayed, a claim for damages on the ground of delayed delivery is at any rate ruled out. All shipping costs, particularly postage and packaging, are based on the price list quoted in our online shop at the time when an order is placed.
Should it not be possible for us to deliver the ordered goods to you, for example because you entered an incorrect address or you were not available at the delivery address you indicated, although you were advised of the time of the delivery with a fair notice period, you will be invoiced the costs of the carrier’s second delivery attempt.
Claims for transport damage must be submitted to the carrier and to us in writing at the latest within three days of receipt of the goods together with a photograph of the damaged product and outer packaging.
Terms of payment
Payment for orders placed in our online shop is to be made in advance by means of prepayment, SOFORT Bank Transfer/eps, PayPal, Apple Pay, Google Pay or by credit card. Payment must be made free of charge to us. We reserve the right to rule out certain payment methods following a creditworthiness check.
All prices quoted are current prices in Euros and are applicable until further notice. Where a price is erroneously quoted and the correct price is higher than that quoted in our online shop, customers will be contacted before the order is confirmed and before the goods are shipped so that they can be asked whether they wish to purchase the product at the correct price or cancel the order.
Postage and packing are invoiced separately at a flat rate and are itemised separately in the order. When customers place an order they agree to the content and amount of these costs. The applicable prices are the prices indicated at the time an order is placed.
In the case of resellers, we are entitled to charge default interest of 5% p.a. in the case of delays in payment, at any rate, though, the statutory default rate of interest. The right to claim further damages remains reserved. Should the amount owed not be paid after a reasonable period for payment has been set, we have the right to withdraw from the contract and/or to claim compensation instead of performance.
Limitation of liability
With the exception of injury to life, limb and health, we are only liable for damages attributable to intentional or grossly negligent conduct. The amount of liability is limited to the average amount of damages typical for such a contract. Insofar as our liability is ruled out or is limited, this also applies to the personal liability of employees, representatives and vicarious agents.
We are only liable for our own content in our online shop. We cannot be held responsible for any third-party content on other websites which are accessible via links on our website.
Samples, catalogues, brochures, images and the like always remain our intellectual property. Customers are granted no rights in use or exploitation whatsoever.
Warranty
Should the delivered goods be defective, you have the option of exchanging them. If we are unable to deliver a replacement or such delivery involves a disproportionately high effort or if delivery of the replacement is delayed beyond a reasonable amount of time, you are entitled to withdraw from the contract and demand repayment of the purchase price. All statutory provisions under the Austrian Commercial Code (UGB) apply to entrepreneurs.
Data protection
By placing an order you consent to us collecting, storing and processing the personal data included in your order. Your personal data will not be made available to any third parties.
Right of withdrawal
In accordance with the statutory right of revocation, consumers have the right to withdraw from the contract without stating reasons.
The withdrawal period is 14 days. This period begins to run upon receipt of the goods. In the case of partial deliveries the period begins to run upon receipt of the last goods to be delivered or the last partial delivery. The withdrawal period is granted if the notice of withdrawal is sent within the stated period.
Withdrawal from contract
Notice of withdrawal does not require any specific form. You may – but do not have to – use the Withdrawal Notice template which you can access on our website by clicking on “Notice of Withdrawal”. If you send us your notice of withdrawal in this way, we will send you an email to confirm receipt.
Consequences of withdrawal
We will pay back all costs, including postage and packing, within 14 days of receipt of your notice of withdrawal using the same payment method you used, unless we have expressly agreed a different payment method. This gives rise to no costs on your part. We may refuse to make the repayment until we have received the goods or you have provided proof of return.
You must return any goods you have received without undue delay, at the latest within 14 days from your notice of withdrawal. You must pay the costs of returning any goods.
You are only required to replace any loss in value of the goods if you were informed by the company of your right of revocation and the diminished value results from handling other than that which is necessary to ascertain the nature, properties and proper functioning of the goods.
Concluding terms
The contractual language is German.
Should the customer breach these Terms and Conditions and we take no action, that should not be interpreted as us waiving our rights. We are still entitled to exercise our rights in the event of another/new breach of these Terms and Conditions.
